I was wondering about the eligibility of applying for Green Card after getting married to a U.S. citizen for a F-1 visa holder currently living in the U.S. Does anyone have any idea about this? Thanks in advance!

you are eligible to apply for bot I-130 and I-485 and all supporting documents such as medical report affidavit of support every thing at once since you are already in usa. then they will call you for interview within 3-4 month and if your marriage is determined to be in true faith then you will get your green card.

Dear friend, Be careful before having marrige with american for obtaining green card throgh marrige. This time very hard to get green card through this process interms of fruad manner. If you reconcile for marrige with american woman, donot trust them, afterthat they gonna braign with you in terms of money. If you donot give money or you donot fullfill her demand anytime you will get problem, US immigration is careful on the matter. too many such cases failed after applying the green card thorough this process due to fake and fruad activities. If you want to have green card I will suggest you what would be the right process. be careful. Yes 1985 to 1995, that time was good for having green card through this process but these days, really problem. Thanks

Thanks for the advice "Sum" and I also appreciate your post "easy" but the thing is, I'm not planning to get married to an American for the sake of Green Card! It's about a close relative of mine who's getting married to an American! And thanks for your concern but this isn't a fraudulent marriage or anything. This is a love marriage ( don't think of it in a typical way now ) and the guy happens to be a heir of a rich family and by rich, we're talking FILTHY rich and him getting married to an American chick was the last thing that his parents would've wanted. Anyways, back to my question. I wanted to know when he's going to be eligible to apply for Green Card, I mean in terms of months or years...like an year after his marriage? or a couple of years or so..Also, if he were someone who got married to an American chick for the sake of Green Card then he'd have already known what the procedures were, but he doesn't have a freaking clue! In fact, he's worried about taking his wife to Nepal ( for Nepali ceremonial marriage ) fearing his F-1 status might be in jeopardy! So, I'd be thankful if "Sum" could elaborate on his reply! Thanks again!

a quick consultation with a lawer which usually does not cost more than $200 can make things crystall. Easy dude is right, i have seen lots of pending green cards for marriages with Americans.. however, recently a friend of mine got a green card within 4 months( conditional) of marriage. It was a real case. they were in love and living together for 3 years already. I think, if the marriage is with your age group and it does't look suspecious like , marrying 50 yr -0ld while you're 25, it happens fast.

your friend is eligible for applying for change in status as soon as he gets married. since his spouse is us citizen his interview will probably be in 4-5 months (from my friends experience). as soon as your friend applies for green card his F1 status will expire but he will get to stay in this country until the interview decision. if he gets regected for green card he will be deported and will not be able to come to usa for several years(hopefully it does not come to that). i think you can get permission to travel until your interview. you can just go to uscis and spend 4-5 hours. they have everything you need. after getting married you need to file I-130,I-485,I-693(medical), (affidavit),(biographical informations), and supporting documents to missouri service center i think i am not sure you can check uscis website. then if they think you have enough supporting documents then they will call you for interview. here are some links that would be helpful to you if you google "family based green card" you can find plenty of website. Cheers "sum" and "dyamn". That's all I wanted to know. This is a pure love marriage and Like I said earlier, the guy comes a very GOOD family...but I'm not gonna go into details about how his family is reacting to this marriage. They've been living together for over a year, she just graduated from College while he's gonna graduate next year! And actually I did go to uscis myself but that was in vain coz for a noob for someone like myself ( about the uscis stuff ) all the I-485 and stuffs were quite confusing. Thanks again!
