Friends, just curious how sooner we can start working for B company if we get GC from A company. Just to be brief can we leave A company (GC field company) immediately and move to another company once we get GC or there is time limit to stay with A Company. Please share your thoughts..

not sure if u legally have to, but they do expect u to stay with them atleast for some period of time. I dont know exactly about GC sponsoring, but i would assume they spend some money on the sponsoring, and if u leave right away, u are basically decreasing the chance of anyone else , especially frm nepal, to be sponsored by that company again. as an example, i knew this company which would pay for the masters degree for its employee, without binding them legally to stay any more with them, but would expect the employees to work for the company after getting masters degree for atleast the same amount of years that it paid their education for. i.e. if the company pays for the 3 years of graduation, it wud expect them to work for the company for 3 more years atleast after graduation. if u are planning to leave because u are being offered a job with much higher pay scale, talk to your managers, and tell them whats up. they will probably end up raising your pay.

I still think there is some kind of law with USCIS that you have to stick with the same company for a year after you get your GC............. Again....I may be wrong.......

I don't think there is any law for this. It depends upon the agreement between the company and the employee. If the employer is ok I think it should be fine. I might be wrong, please correct me if I am. The GC is for future employment.

I'm sorry I was wrong on this. Apparently, USCIS wants people to stick to the sponsoring employer for some time before changing, thats the common sense law and is the basis of how we get the green card. Now, how much time is not defined in the law. If this is not followed, they may question when applying for citizenship. Man, we can never get out of this sticking to the employer thing, even after getting the GC. Also, if you change your type of job (like you change from web developer to financial analyst and they are alerted , they can raise a fraud and cancel the GC altogether.

i agree with Justfunny only if you want to apply for citizenship in future. In another words, it does not really matter when you change the job if you plan not to get the US citizenship. But if you plan to change your green card ultimately to the citizenship then it is better option to stay with the company A for at least one year. My cousin was asked to show the proof of the employment with the company in the citizenship interview. From what I know, there is chance of you being asked that question in the citizenship interview and as well as of not being raised that question to you. Its matter of luck. If that paper is being asked and you cannot provide that paper then you are ineligible for the process and you will be deported for not abiding with the US laws.

Again, whether its 1 year or 6 months is arguable and may not be clearly defined in law. Still snake, did your cousin change employer after 6 months or 1 year and from which state?

you have to be with the company A for at least 180 working days. company A can effect on your immigration status withing 180 days, then you will be free to fly!

My cousin was there for one whole year because he took a lawyer's advice. I think the lawyer gave him a wise advise because they did ask for that paper in the interview. So guys try to stick for one year before you jump to another.

We are just talking about from employees perspective, what happens if the employer lays you off within 3 months or 6 months or 1 yrs after getting a green card? Is there any law on that? Are the companies punished?

Radiohead, anybody can talk like an authority figure. However, what source do you have to make such a claim? Ke khulkincha kulkidaina bhanna ko basis ke ho, write article number of the law. Anybody can do a guessing game, I could have done that too.

In my case, my employer will not file a case against me even I leave early but I don't want to jeopardize my citizenship application later. Thats why people like me want to become sure about what is the safe period for sticking with the petitioning employer. Advice from a immigration expert/lawyer is highly appreciated.
